Article 1, Identity of the seller

Orders are packed and shipped on behalf of the seller by its partner warehouse Shots in Beverwijk, the Netherlands. The seller remains your contracting party for everything related to your order.

Article 2, Applicability and age
These terms apply to every offer of MARROYSTOYS S.L. on bdsmking.eu and to every distance contract concluded between the seller and a customer. The webshop and its products are intended exclusively for persons aged 18 or over. By using this website and by placing an order you confirm that you are at least 18 years old. The seller may cancel an order if there are indications that the customer is under 18.

Article 3, The offer
Products are described with care, based on the information supplied by the manufacturers. Images give a true representation of the products; small differences in colour or packaging are possible. All offers are subject to availability. If an ordered product turns out to be unavailable, the seller informs the customer and refunds any amount paid for it within 14 days. Obvious mistakes or errors in an offer do not bind the seller.

Article 4, The contract
The contract is concluded when the customer completes the order and receives the order confirmation by e-mail. The seller stores the order and sends the customer an invoice by e-mail. The seller takes appropriate technical and organisational measures to secure electronic payments and data transfer.

Article 5, Prices and payment
All prices are in euros and include VAT. Shipping costs are shown separately before the order is placed. Payment is made through the methods offered at checkout: card payments (also through Apple Pay and Google Pay), PayPal, Klarna (in the countries where it is available for payments in euros) and local payment methods such as iDEAL, Bancontact, BLIK, Przelewy24, EPS, MB WAY and Multibanco, all processed by Stripe. The amount is charged when the order is placed, and the order is shipped once the payment has been confirmed.

Article 6, Delivery
Orders are shipped from the warehouse of the seller's logistics partner in the Netherlands and delivered by UPS or DPD to the countries listed on the Shipping & returns page, where the shipping costs and expected delivery times per country are also stated. Delivery times are estimates. The seller delivers at the latest within 30 days of the order, unless a longer period was agreed. If delivery is delayed or not possible, the customer is informed and may cancel the contract free of charge with a full refund. The risk of loss or damage passes to the customer at the moment of delivery. For deliveries to the United Kingdom, import duties and taxes may be charged on delivery; these are paid by the recipient.

Article 7, Cancellation before dispatch
The customer may cancel an order by e-mail to info@bdsmking.eu as long as it has not been shipped. The seller then refunds the full amount paid within 14 days. Once the order has been shipped, the right of withdrawal in Article 8 applies.

Article 8, Right of withdrawal
A consumer may withdraw from the contract within 14 days of the day on which the consumer, or a third party designated by the consumer, receives the goods, or the last item of an order delivered in several parts, without giving any reason. To exercise this right, the consumer informs the seller by a clear statement, for example an e-mail to info@bdsmking.eu or the model withdrawal form below. The consumer returns the goods without undue delay and at the latest within 14 days of the notification, with all supplied accessories. The direct cost of returning the goods is borne by the consumer, unless the goods are faulty or not as ordered. The consumer is only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Article 9, Exceptions to the right of withdrawal
In accordance with Article 16(e) of Directive 2011/83/EU and Article 103(e) of the Spanish General Law for the Protection of Consumers and Users, the right of withdrawal does not apply to sealed goods that are not suitable for return for health protection or hygiene reasons and that have been unsealed after delivery. This includes intimate products supplied with a hygiene seal or protective packaging, such as toys, lubricants and chastity devices, once that seal or packaging has been opened.

Article 10, Refund
The seller refunds all payments received from the consumer, including the standard delivery costs, without undue delay and at the latest within 14 days of receiving the withdrawal notice, using the same payment method the consumer used, at no extra cost. The seller may withhold the refund until the goods have been received back or the consumer has provided proof of return shipment, whichever is earlier.

Article 11, Conformity and legal guarantee
The seller guarantees that the products comply with the contract and with the statutory requirements of EU and Spanish consumer law. The legal guarantee of conformity lasts three years from delivery. In the event of a lack of conformity, the consumer is entitled to repair or replacement and, where this is not possible, to a price reduction or termination of the contract. Damage caused by misuse, normal wear or not following the manufacturer's instructions is not covered.

Article 12, Use of the products
Products are intended for use by adults, for their intended purpose and in accordance with the manufacturer's instructions supplied with the product.

Article 13, Complaints
Complaints about the performance of the contract must be submitted, fully and clearly described, to info@bdsmking.eu. Complaints are answered within 7 working days of receipt; if handling takes longer, the customer is told when to expect an answer.

Article 14, Personal data
The seller processes personal data in accordance with the GDPR, as described in the privacy policy.

Article 15, Applicable law and disputes
Contracts between the seller and the customer are governed by Spanish law, without prejudice to the mandatory consumer protection rules of the country in which the consumer lives. If a complaint cannot be resolved together, the consumer can contact the consumer protection authority or the European Consumer Centre in their country, and retains the right to bring the matter before the competent court.
